After a PI claim notification, the insurer will usually review both the facts and the policy response.
The next steps can include:
- requesting further project records or correspondence
- reviewing the contract and scope of services
- considering whether the matter falls within the policy
- appointing a claims handler, solicitor, engineer or other expert where needed
- asking the insured not to make admissions or settlements without approval
- assessing possible defence, settlement or rectification strategies
Notification does not automatically mean the insurer has accepted that the policy responds to every aspect of the matter.
The engineer should continue preserving relevant records and forward new correspondence promptly. If the claimant imposes deadlines, legal proceedings are issued or circumstances change materially, tell the broker and insurer immediately.
Where urgent safety or loss-prevention action is necessary, it should not be delayed, but significant financial commitments should be discussed with the insurer where reasonably possible.
