NSW engineer registration applies to specified professional engineering work on regulated buildings.
The scheme applies to professional engineers working on class 2, 3 and 9c buildings, and buildings containing a class 2, 3 or 9c part. Registration classes include:
- civil
- electrical
- fire safety
- geotechnical
- mechanical
- structural
Only individuals can register as professional engineers under the NSW scheme; companies cannot hold this registration.
Insurance is also part of the regulatory framework. A registered practitioner must meet the applicable insurance requirements for the work they undertake. Depending on the business structure, the relevant Professional Indemnity cover may sit with the individual, partnership or company, but the arrangement still needs to satisfy the statutory requirements applying to the practitioner and the regulated work.
The NSW scheme is not a general registration requirement for every engineer or every project. The first questions are therefore whether the building is regulated and whether the engineering work falls within one of the prescribed professional engineering classes.
